KC Luxury Sues NDLEA, Demands ₦190 Million Over Alleged Unlawful Arrest, Detention and Invasion of Privacy

Social media influencer and businessman Afolabi Kazeem Michael, popularly known as KC Luxury, has sued the National Drug Law Enforcement Agency (NDLEA) before the Federal High Court in Lagos, challenging his continued detention and demanding ₦190 million in damages over alleged unlawful arrest, detention, invasion of privacy and the circulation of his photographs and videos while in custody.

KC Luxury was arrested by NDLEA operatives on August 13, 2026, at the Murtala Muhammed International Airport, Lagos, while preparing to travel to Paris. The agency linked his arrest to an investigation into the interception of 184.50kg of c%caine allegedly connected to an international drug tr@fficking cartel using Nigeria as a transit route to the United Kingdom, Europe and Asia.

The NDLEA also claimed that its investigation led to the seizure of foreign currencies and luxury items, as well as searches connected to the case.

However, in a fundamental rights enforcement suit filed through his lawyer, Abdulakeem Labi-Lawal (SAN), KC Luxury asked the court to declare his continued detention without charge unconstitutional and a breach of his right to personal liberty.

In an affidavit sworn by his father, Eric Afolabi, he claimed that KC Luxury had spent 14 days in NDLEA custody without being informed of the specific offence for which he was detained or formally charged before a court.

He further alleged that NDLEA operatives searched his residence at Movamo Court, Banana Island, Lagos, after his arrest without presenting a search warrant, but found nothing incriminating.

He is seeking an order for his immediate release or bail on favourable terms pending any criminal charges.

Justice Friday Ogazi declined the ex parte application and ordered that the NDLEA be put on notice to respond. The court also directed the agency to produce KC Luxury at the next hearing, serve the relevant documents within four working days and file its response within five days of service.

The matter was adjourned to September 9, 2026, for hearing of the substantive application.
