Top German Conservative Leader Resigns Amid Controversy Over Having Child With his Husband Through U.S. Surrogacy

Senior German politician Jens Spahn has resigned as chairman of the parliamentary group of Chancellor Friedrich Merz’s centre-right Christian Democratic Union (CDU) following intense political criticism over his decision to have a child with his husband through a surrogate mother in the United States.

Spahn, one of the CDU’s most prominent figures, announced his resignation after days of public and political debate over the circumstances surrounding the birth of his child.

While commercial surrogacy is prohibited in Germany, the arrangement was carried out legally in the United States, meaning Spahn did not breach German law.

Nevertheless, the development triggered widespread discussion, particularly within the CDU, a party that has long championed conservative family values and has traditionally opposed surrogacy.

In a letter to colleagues announcing his decision, Spahn said the controversy surrounding his private life had become incompatible with his responsibilities as a senior political office holder.

“In recent days, I have come to realise that my personal happiness in starting a family with my husband and becoming a father is incompatible with my political office,” he wrote.

His resignation has fuelled renewed debate across Germany over the country’s ban on surrogacy and the broader legal, ethical and social questions surrounding assisted reproduction, same-sex parenting and the evolving definition of family.

The development has also prompted fresh discussions about the extent to which the private lives of elected officials should influence their political careers, with supporters arguing that Spahn acted within the law, while critics maintain that public figures should reflect the values traditionally associated with their parties.
